Notes
A Revolutionary War veteran. He enlisted in Warrenton, Va., in the summer of 1780 as a substitute
for Peter Crim in the Company of Captain Francis Triplett. He marched to Hillsborough, N.C., where he entered the Brigade of Colonel Margan. After the Battle of the Cowpens he was detached to Fauquier under Lieutenant Dearin, where he arrived in March 1781 and was discharged. Pension granted 1831. REF: Withers-America by Franz V. Recum, p. 56-57.
He enlisted in Jun 1781 and served as an orderly Sergeant seven months in Col. Edmond's Virginia Regiment.

In 1804, his father willed him a portion of a tract of land in Culpepper where Spencer's brother James was residing, and a portion (presumably half) of an adjacent tract of 109 acres. He also received "several negroes, horses, cattle, hoggs [sic] etc." that were on that land. In addition, his father instructed that 20 or so of his slaves be sold, as well as stocks of horses, cattle, hoggs, & sheep, and household and kitchen furniture and other property at a public auction, and that the proceeds to be divided equally among his children; however, the shares of Spencer and Susanna were to be detailed by the executors until a later date "so as not to be squandered".
From Rev. Pension Records: Spencer Withers, VA Line, S6400, sol was b in 1765 in Fauquier Co., VA & he lived there when he enl. at Warrenton VA and was living there when he appl. 30 Aug 1832. In 1833 he stated he had also lived in Mason Co., KY and in the state of TN but had returned to Fauquier Co., VA in 1813. Died 24 Apr 1834.
There is also a land grant record from John Chrisman to his father-in-law Spencer Withers of land in Mason Co., [West] Virginia.

Spencer Withers was only 15 years old when he enlisted at Warrenton, Va, in the summer of 1780 as a substitute for Peter Crim in the Company of Captain Francis Triplett. He marched to Hillsbourough, N.C., where he entered the brigade of Colonel Morgan. He fought in the battle of Cowpens as his brother Lewis had and after that was detached to Fauquier under Lieutenant Dearin, arriving home in March of 1781 and then discharged.
He was christianed by Rev. Craig. Following his discharge, he went to live on 210 acres of land that his father owned in Culpepper Co., Va. He married Esther Potts and they became some of the early settlers of Cledinin District, Mason Co., West Virginia. Esther died in Mason County, 18 July 1818 and the house was consumed by fire the same year. Spencer returned to Culpepper Co, Va., to live in 1823. In 1831 he was granted an annual pension of $80.00 for his military service. He died in Culpepper Co., Va, on 24 Apr 1843.

Virkus VI:648 states that he moved to Mason County in 1810, but later returned to Culpeper County, leaving his wife behind in Mason County living with his son Jacob until death.
The following is an exact transcription of a land deed is filed in Mason County records, page 264-5 of something (but I don't have the exact citation), copy send to me courtesy of Nathiel Kraemer, and to her by Betty Williams, who probably located it.
"This indenture made and entered [?] this 20th day of April in the year of our Lord one thousand Eight hundred and forty nine. Relucenrs[?] Jacob Withers and Nancy his wife, Samuel Griggs and Mary his wife formery Mary Withers, Sarah Wallace widow of [Henry] Wallace Dec'd formerly Sarah Withers, Rachel Withers, Susan Withers and Kathy Potts widow of Aquilla Potts dec'd formerly Kathy Withers, John Chrisman representing [heirs] of Elizabeth Chrisman of the first part, and William Withers of the second part. The parties being heirs and representations of the late Spencer Withers dec'd. Witnesseth [had wherein] the said Spencer Withers died possessed of a certain tract or parcel of land containing 220 acres on the Ohio 16 mile creak in the County of Mason which was conveyed to him by [Mary A. Jouin, James T. Jouin] & wife, & William Clark and wife by deed bearing date the 25th day of January [1840] and duly recorded in the County Clerk's office of Mason County to which Refference may be had. Now this Indenture further witnesseth that for and in consideration of the sum of For hundred & Sixty seven Dollars to these the Said Parties of the first Part in hadn Paid by the land party of the second part the receipt and payment whereof is hereby [enfefeid] and acknowledged they the said parties of the first part [?] and bargained sold and conveyed and by these presently do bargain, sells and convey onto the said party of the second part in his actual possession [?] being and to

And the said party of this first part for themselves, their heirs & executors and administrators do consent, forever and [ajince] to and with the said party of the second part his heirs and assigns the above bargained promises in the quiet and peacable possession of the said party of the second part his heirs and assigns against them the said parties of his first part and against all persons lawfully claiming by, through, or under them or [wither] of them, will forever warrant and difend, each individually as far as this portion of the said 89 acory of land appertained.
